Ayustar Corp. exercises no control what is over the content of the information
passing through its Network or the Internet.
2. Ayustar Corp. makes no warranties of any kind, whether expressed or written,
for the service it is providing. Ayustar Corp will not be held responsible
for any resulting damages. This includes loss of data resulting from delays,
non-deliveries, mis-deliveries, Year 2000 or service interruptions caused
by power or telephone company failures, acts of God, or your own errors
or omissions, or our own. Ayustar Corp, makes no guarantees as to client
content, be it integrity or backups, unless it is contractually specified.
3. Ayustar Corp, services may only be used for lawful purposes. Transmission
of any material violating any U.S., Puerto Rico, or any other country's
regulations is prohibited. This includes, but is not limited to: copyrighted
material, material legally judged to be threatening or obscene, or material
protected by trade secret. You agree to indemnify and hold harmless Ayustar
Corp, from any claims resulting from your use of the service, which causes
damage to you or another party.
4. Any access to other networks through the Ayustar Corp Network must comply
with the rules appropriate for that other network. Idle dial-up connections
may be automatically terminated. Multiple simultaneous dial-up connections
will not be able to connect. Dial-up accounts have unlimited access not
dedicated access.
5. Use of any information obtained via the Ayustar Corp Network is done
so at your own risk. Ayustar Corp. Specifically denies any responsibility
for the accuracy or quality of information obtained through its services.
6. Ayustar Corp does not promote or allow pornography in our user sites,
or any other hosted site. Any user posting this type of information will
be notified in a timely manner and requested to remove said material immediately.
Not doing so will represent a violation of our terms and conditions and
will be subject to an immediate cancellation of the appropriate account,
and applicable disconnection charges.
7. Fees - Subject to change without notice. Applications for domain changes
to other providers will be charged a processing fee. Multiple account offers
are based on single billing (billing to one person, business, or address).
8. All invoices are processed electronically. Payment is due when you receive
an invoice. Accounts are in default if payment is not received within 10
days after the date of the invoice. If your payment is returned to us, unpaid,
you are immediately in default and subject to a charge of $10.00 from us.
Accounts determined to be in default will have their service interrupted.
Such interruption does not relieve you from the obligation to pay the account
charges. Only a written request to terminate your service relieves you of
your obligation to pay future account charges. Cancellation of accounts
will be valid if requested prior to the next billing cycle.
9. Accounts in default are subject to a $10.00 reconnection fee. If you
default, you agree to pay Ayustar Corp. it's reasonable expenses, including
attorney and collection agency fees, incurred in the enforcing of its rights
under these Terms and Conditions. Accounts in default may have their
service interrupted. Such interruption does not relieve you from the
obligation to pay the monthly account charge.
10.Our service will be billed on a
monthly basis as long as your account is active. It is the
client/user responsibility to notify Ayustar Corp. about any problems with
the service Ayustar renders. Not using the service does not relieve the
client/user from the obligation of paying for the service
11. Ayustar Corp. reserves the right to cancel an account at any time. Cancellations
will be subject to return of fees in a pro-rated manner. Ayustar Corp. reserves
the right to change the rates and otherwise modify these Terms and Conditions
by notifying you 30 days before the effective date of the change. Client
data will be removed and deleted if accounts are expressly cancelled by
the customer or by Ayustar Corp.
12. Under no condition will Ayustar Corporation allow
what is called "spamming".
Under the "Unsolicited
Commercial Electronic Mail Act" of 2001 we have the authority by
law to ban any unsolicited email. The user must label the email
subject by preceding it by the following words: "SPAM" or "ADV:SPAM",
and also must provide clear opt-out instructions.
13. Ayustar
Corporation offers free Anti-Virus and Anti-Spamming protection for all
customer email accounts. However, Ayustar
Corporation
adheres no responsibility for damages caused by a virus to the operational
system of customers’ personal computers. All customers are held
responsible for the safekeeping of their own personal equipment. In
addition, Ayustar
Corporation's
Anti-Spamming software filters unsolicited commercial email (a.k.a. SPAM)
that enters its servers, yet the filtering process does not eliminate in
it’s totality the possibility that SPAM may enter customer email
accounts. Ayustar
Corporation
also relinquishes any responsibility for the content of unsolicited
commercial email.
14.
Web hosting clients/users will be responsible to maintain up-to-date
copies of their web site's content. Ayustar Corporation
is
not responsible for any loss of web site content, data or information,
unless specifically stipulated in the client/user contract.
15. These Terms and Conditions
supersede all previous representations, understandings or agreements.
Use of Ayustar
Corporation
Services constitutes an acceptance of these Terms
and conditions.
DISCLAIMER:
Your phone bills are your responsibility. Always check with your phone
company whether a dial-in number is local to you.
